  • Long-Term Suspension (up to 45 days) or Expulsion:

    • Applicable for Serious Violations: These include incidents involving weapons, bodily injury, or the use or possession of drugs and alcohol.

    • Consequences: Options include placement in an Interim Alternative Educational Setting (IAES) or expulsion.


  • Considerations Under Section 504:

    • Drug and Alcohol Use: A student currently using drugs or alcohol is not considered a student with a disability under this section.

    • Recovery Status: A student who has received treatment for drug or alcohol use and is no longer using is considered a student with a disability.


  • Disciplinary Measures Beyond 10 Days:

    • Under IDEA: There is no termination of special education services despite the suspension or expulsion.

    • Under Section 504: There is no obligation to provide educational services during the suspension or expulsion period.
