Long-Term Suspension (up to 45 days) or Expulsion:
Applicable for Serious Violations: These include incidents involving weapons, bodily injury, or the use or possession of drugs and alcohol.
Consequences: Options include placement in an Interim Alternative Educational Setting (IAES) or expulsion.
Considerations Under Section 504:
Drug and Alcohol Use: A student currently using drugs or alcohol is not considered a student with a disability under this section.
Recovery Status: A student who has received treatment for drug or alcohol use and is no longer using is considered a student with a disability.
Disciplinary Measures Beyond 10 Days:
Under IDEA: There is no termination of special education services despite the suspension or expulsion.
Under Section 504: There is no obligation to provide educational services during the suspension or expulsion period.
