This protection extends to social situations, ensuring that individuals with autism have the same rights to participate in dating and social activities as anyone else.


Consent and Capacity: Legal standards around consent to sexual activity consider the mental capacity to make informed decisions. Individuals with autism are considered capable of consenting to relationships and sexual activity unless there are specific impairments that significantly impact their ability to understand and agree to the activity. This is assessed on a case by case basis.
