The Texas Education Agency (TEA): Legal Framework Children in Private Schools

The Texas Education Agency (TEA) provides a legal framework that addresses the situation of children with disabilities who are parentally placed in private schools, including religious ones. According to this framework, "children with disabilities parentally-placed in private schools" refers to students with disabilities whose parents have enrolled them in private or religious schools that qualify as elementary or secondary schools.


Under the Individuals with Disabilities Education Act (IDEA), these children do not have the same rights to services as children with disabilities in public schools. Instead, public school districts are required to spend a proportionate amount of federal IDEA funds to provide services to children with disabilities in private schools. However, the specific services provided are determined by the district and may not be as comprehensive as those offered in public schools.
